1. Granting of consent:

1.1 By entering into the contract, the Data Subject hereby grants the Trading Company:

as the Data Controller, consent to the processing of your personal data under the conditions set out below.

1.2 The Company takes care to protect your personal data in accordance with the valid and effective legislation, which since 25 May 2018 is in particular Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "Regulation").

1.3 The Company is the operator of the website at the address indicated in the header (hereinafter referred to as the "Portal"), through which it provides its goods. The Policy applies to all personal data processed by the Company in performance of a contractual relationship, legal obligation, legitimate interest or consent, through the Company's Portal. The Policy describes how the Company uses and protects personal data.

1.4 The Company may amend this Policy at any time by posting a revised version on the Portal, and such amendment shall be effective as of the date of such posting.

1.5 The controller of personal data within the meaning of Article 4(7) of the Regulation is the company named above in the header.

1.6 Consent to the processing of personal data in its entirety according to this article is not a condition that would in itself prevent the conclusion of a contract.

1.7 Personal data will be processed in electronic form in an automated manner or in paper form in a non-automated manner.

1.8 The Customer confirms that the personal data provided is accurate and that he/she has been informed that this is a voluntary provision of personal data.

1.9 When using the Portal, even without registration, the Company will log your IP address and standard data such as your browser type and the pages you have viewed on the Portal. This information is used to monitor and prevent fraud, diagnose problems and to process statistical data that is anonymous and does not include your personal data.

2. Personal data to be processed:

(a) name and surname
(b) postal address
(c) e-mail address
(d) telephone contact

3. The purpose of processing personal data is:

3.1 Sale of goods in the online shop at the web address listed in the header
3.2 Sending commercial communications to the Buyer by the Seller
3.3 Discount bonus program for Buyers
3.4 Registration in the Seller's e-shop
3.5 Pre-contractual negotiations
3.6 User account management
3.7 Answer to the question in the eshop inquiry form
3.8 Providing tailored advertisements, sponsored content and sending promotional information to Data Subjects
3.9 Evaluating and analysing the market, customers, products and services (including asking for opinions on the Seller's products and the eshop)
3.10 Organisation of prize competitions or promotional events

4. Processing of personal data for the performance of the contract

4.1 In the case of registration of the Data Subject as a customer, the personal data is processed in accordance with the provisions of Article 6, paragraph 1, letter b) of the Regulation - the provision of personal data is a necessary requirement for the performance of the contract or for the implementation of measures taken prior to the conclusion of the contract at the request of the data subject. Without the provision of personal data, it is not possible to carry out pre-contractual negotiations, conclude a contract or perform it by the company.

5. Personal data may be disclosed to the following third parties:

5.1 The processing of personal data is carried out by the Controller, but personal data may also be processed for the Controller by the following processors:
(a) suppliers, consultants, carriers and other service providers involved in the sale and delivery of goods, handling of claims and making payments
(b) related companies - companies that are owned or controlled by the company
c) business partners - trusted companies that may provide information about products and services where the Data Subject has provided separate consent.
d) law enforcement - when challenged by government authorities or to protect customers

5.2 Possibly other providers of processing software, services and applications, but not currently used by the Controller.
5.3 The Buyer acknowledges that the personal data provided to the Seller for marketing purposes is provided to the Seller voluntarily. The consent to the processing of personal data granted to the Seller for marketing purposes is valid for the period of 7 years, but no later than until the Buyer withdraws consent.
5.4 The Buyer can easily unsubscribe from receiving commercial communications by clicking on the link Log out in an e-mail containing a commercial communication or by using the contact form or contacting the Seller via the hotline.
5.5 As part of the complaints procedure, the following information is required from customers: name, surname, address, telephone number, e-mail and signature or biometric signature. All personal data thus obtained is processed solely for the purpose necessary to process the complaint.
5.6 Furthermore, the Seller may process "cookies" when consent is given, in order to facilitate the provision of information society services, in accordance with the provisions of Directive 95/46/EC on the purpose of "cookies" or similar tools, and it is ensured that users are aware of the information that is stored on the end device they are using, Users have the option to refuse that "cookies" or similar tools are stored on their end devices, e.g. by activating the anonymous browsing functionality in their browser.

6. Security measures

6.1 Each user's account is protected by a user password. We recommend that you keep the password secret and do not disclose it to third parties, even via email, in which the password will be requested. The Company does not send email messages to Users that include a request for a password in the email. In the event of a forgotten password, the user will receive, at his/her request and to the email address provided in the registration, an email containing a temporary password to access his/her account and choose a new password.

6.2 The company is not liable for misuse of the provided data that occurs as a result of unauthorized access by a third party or in the course of data transmission within communication networks. The User acknowledges that data and information provided on the Internet, e.g. in discussion forums, chat rooms or e-mail, may be misused by third parties.

6.3 The Seller reserves the right to use anonymised data on the activity of users of the web applications to improve its services.

7. Cookies and internet beacons

7.1 So-called cookies (session ID cookies and persistent cookies) are used to store and occasionally track visits to the Seller's website. A cookie is a small text file that is stored on the Data Subject's computer for recording purposes. The Seller uses cookies to facilitate navigation of its website. When the Data Subject closes its browser, the session ID cookie expires. A persistent cookie remains on the Data Subject's hard drive for a longer period of time. The Seller also stores screen resolution and determines whether JavaScript is enabled in the browser to facilitate browsing of the Seller's website. Most internet browsers are set to automatically accept cookies.

7.2 The Seller uses two categories of cookies:
a) Functional: These cookies are required for the basic functioning of the website and are therefore always enabled; they include cookies that allow the Data Subject to remember the website during a single visit. These cookies further assist in security and in complying with the requirements set by law.
b) Social media and advertising: Social media cookies offer the possibility to link the Data Subject to social networks and share content from the Seller's website on them. Advertising cookies (third-party cookies) collect information to help better tailor advertising, both on and off its website. In some cases, these cookies include the processing of the Subject's personal data. Refusal of these cookies may result in the display of advertisements that are not as relevant to the Subject, or the inability to effectively connect with accounts on Facebook, Twitter or other social networks, and/or the inability to share content on social media.

7.3 Cookies can be deleted or refused according to the instructions in the support file of the internet browser. If cookies are removed, the ability to fully enjoy all aspects of the Seller Portal may be restricted.

7.4 The Seller may also collect data when using the e-shop by means of web beacons. These beacons are electronic images that can be used on the Seller's portal in connection with the sale of goods or in emails sent by the Seller. The latter uses beacons to transmit cookies, to count visits and to tell the customer whether an e-mail has been opened and processed. The seller may also collect information about the buyer's computer or other access device to mitigate risks and prevent fraud.

8. Recording phone calls

8.1 With the prior express consent of the Subject, the Processor may record telephone calls and process recordings of telephone calls on the customer service line, in particular for the purpose of contract negotiations, proposals for changes to contractual arrangements, additional information to ensure the performance of the contract, improving the quality of services, the application of complaints, etc. The Subject consents to the recording and processing of telephone calls by continuing the calls after the operator has notified the Subject that his/her call will be recorded. If he/she does not wish to be recorded, the Subject shall hang up and use another of the communication channels after being notified that his/her Your call is being recorded.

9. Lessons learned

9.1 The data subject declares that he/she has been duly instructed by the Administrator on the processing and protection of personal data, that the above personal data is accurate and true and is provided to the Administrator voluntarily.
9.2 The data subject gives his or her explicit consent to the processing.
9.3 Consent can be withdrawn at any time, for example by sending an email or letter to the company's contact details.
9.4 The Seller takes all reasonable physical and technical measures to secure the information collected in connection with the sale of goods in its online shop.
9.5 In accordance with the provisions of Article 13 of Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016, the General Data Protection Regulation (the "Regulation"), the Controller hereby informs that:

  1. the personal data of the Data Subject will be processed on the basis of his/her free consent, under the conditions set out above,
  2. the reason for providing personal data to the Data Subject is, in addition to the above, the Data Subject's interest in receiving commercial offers from the Controller, which would not be possible without the provision of such data
  3. the processing of the Data Subject's personal data will not involve automated decision-making or profiling
  4. The controller has not appointed a data protection officer or designated a representative to carry out its obligations under the Regulation
  5. The controller does not intend to transfer the personal data of the Data Subject to a third country, an international organisation or to third parties other than those mentioned above,
  6. The data subject has the right (e.g. in the administration of his/her profile after logging in, by email or by mail):
    (a) the right to access your personal data (i.e. the right to be informed whether your data is being processed and, if so, the right to access it);
    b) the right to rectification of personal data (i.e. to request rectification if you find that the company is processing inaccurate or false data);
    (c) the right to request an explanation (i.e. if you suspect that the processing of personal data violates the protection of your personal and private life or the processing is in breach of the law);
    (d) the right to restriction of the processing of personal data (i.e. the right to request a temporary restriction of the processing of your personal data);
    e) the right to erasure of personal data (i.e. if your data is no longer necessary for the purposes for which it was processed);
    (f) the right to object to the processing of personal data (the company must demonstrate that there is a compelling legitimate reason for processing personal data that overrides your interests or rights and freedoms);
    (g) the right to data portability (i.e. the right to request that a third party receives your data);
    h) the right to withdraw consent to the processing of your personal data at any time;
    i) the right to lodge a complaint with the Office for Personal Data Protection (i.e. if you believe that your right to personal data protection has been violated).
